A Flexa Cloud Brasil LtdaFlexa Cloud, a private legal entity registered with the CNPJ under number 21.464.937/0001-98, with headquarters at Rua Moacyr Saudino, 300, Box 51, Centro, Alfredo Chaves/ES (“Flexa Cloud”), recognizes the importance and sensitivity of the electronic records and personal data left by you (“User”) when using its various websites and services (“Pages”). This Privacy and Personal Data Protection Policy (“Policy”) aims to inform you, in a transparent, clear and objective manner, what data is processed, for what purpose, under what legal basis, with whom it may be shared and how you can exercise your rights.

This Policy applies to Pages related to any of Flexa Cloud's brands, as listed on the official website. https://www.flexa.cloud, encompassing all its products and services. The processing of personal data fully complies with Law No. 13.709/2018 (General Data Protection Law, "LGPD") and other applicable regulations, including those issued by the National Data Protection Authority (ANPD).

This Policy may be updated at any time by Flexa Cloud, with notice posted on its website and/or by email, if the User has opted to receive communications. The current version will always be available on this page, indicating the date of the update.

1. WHAT DATA DO WE USE?

Flexa Cloud processes two types of personal data: (i) data actively provided by the User; and (ii) data collected automatically during the use of the Pages.

1.1. Information provided by the User. Flexa Cloud collects information actively entered by the User on the Pages, such as full name, email, phone number, company, job title, city, and state, when filling out contact forms, registration forms, or service requests. This information is used to respond to requests, provide and manage services, and, with consent or as otherwise provided by applicable law, for communication and dissemination of products, content, and events.

1.2. Data collected automatically. Flexa Cloud also automatically collects information such as the characteristics of the access device and browser, IP address (with date and time) and its origin, click data, pages accessed, originating and destination pages, and search terms used. To this end, industry-standard technologies are employed, such as cookies, pixel tags, beacons, and local shared objects, in order to enable the functioning of the Pages, improve the browsing experience, measure audience, and personalize content according to the User's habits and preferences.

It is possible to disable automatic data collection through your browser settings and the cookie management panel available on our website. However, disabling certain technologies may affect the functioning of some features of the Pages that depend on the processing of this data.

2. HOW AND WHY WE USE THE DATA (PURPOSES AND LEGAL BASES)

Flexa Cloud processes personal data for the following purposes, always supported by at least one legal basis under the LGPD (Brazilian General Data Protection Law):

Flexa Cloud may centralize the collected information, using it on pages and services related to its brands, respecting the purposes and legal bases described herein.

3. DATA SHARING

The information collected may be shared by Flexa Cloud in the following circumstances:

i. Com operators and suppliers that provide essential services to Flexa Cloud's activities, such as infrastructure and hosting (cloud) providers, payment intermediaries, analytics and marketing tools, are always contractually obligated to process data in accordance with this Policy and the LGPD (Brazilian General Data Protection Law);

ii. With other companies in the economic group from Flexa Cloud, which commits to using the information for the purposes set forth in this Policy;

iii. With partner companies, when necessary for the development of commercial activities;

iv. For protection of interests Flexa Cloud is not liable for any type of dispute, including legal action;

v. In case of corporate transactions and changes, in which case the transfer of information will be necessary for the continuity of services; and

vi. By means of court order or request from a competent administrative authority.

4. INTERNATIONAL DATA TRANSFER

Considering that Flexa Cloud uses cloud computing provider infrastructure and may be part of an economic group operating in other countries, some personal data may be transferred and stored outside of Brazil. In these cases, Flexa Cloud adopts the safeguards required by articles 33 to 36 of the LGPD (Brazilian General Data Protection Law), ensuring that the recipient offers an adequate level of personal data protection through specific contractual clauses, guarantees, and/or other mechanisms recognized by the ANPD (Brazilian National Data Protection Authority).

5. HOW WE USE COOKIES

Cookies are files or pieces of information stored on your device when you visit Flexa Cloud pages. Flexa Cloud uses cookies to enable the functioning of the pages, adapt them to your interests, compile usage information, and improve structures and content.

6. HOW WE KEEP DATA SECURE

Flexa Cloud stores the collected information on its own or contracted servers and uses appropriate technical and administrative means to preserve the security and privacy of the data, in compliance with the LGPD (Brazilian General Data Protection Law) and the guidelines of Decree No. 8.771/2016, adopting, among others, the following precautions:

i. Use of encryption techniques and, where applicable, anonymization of data;

ii. Protection against unauthorized access to systems;

iii. Restricted access control to authorized personnel in the information storage environment;

iv. Commitment to confidentiality on the part of those accessing the information, under penalty of liability under Brazilian law; and

v. Maintenance of inventory and access records, as per article 13 of Decree No. 8.771/2016.

No system is completely immune to incidents. Flexa Cloud makes its best efforts to protect data and encourages Users to adopt self-protection measures, such as keeping their usernames and passwords confidential. In the event of a security incident that may cause significant risk or harm to data subjects, Flexa Cloud will notify the ANPD (Brazilian National Data Protection Authority) and the affected data subjects, within the timeframes and conditions stipulated in the LGPD (Brazilian General Data Protection Law) and applicable regulations.

7. INFORMATION RETENTION

The collected information will be kept for the period necessary to fulfill the purposes for which it was collected. Once these purposes have ended, the data will be deleted, except in cases of retention authorized by Article 16 of the LGPD (Brazilian General Data Protection Law), namely: compliance with a legal or regulatory obligation; study by a research body (with anonymization whenever possible); transfer to a third party, respecting legal requirements; or exclusive use by Flexa Cloud, with access by third parties prohibited, provided that the data is anonymized. Connection and application access data are kept for the applicable legal periods (Brazilian Internet Civil Rights Framework, Law No. 12.965/2014).

8. YOUR RIGHTS

In accordance with Article 18 of the LGPD (Brazilian General Data Protection Law), Flexa Cloud guarantees the User the following rights:

i. confirmation of the existence of treatment;

ii. access to data;

iii. correction of incomplete, inaccurate or outdated data;

iv. anonymization, blocking or deletion of unnecessary, excessive or processed data in violation of the LGPD;

v. portability of data to another service or product provider, upon express request;

vi. deletion of data processed based on consent;

vii. Information about the public and private entities with which Flexa Cloud shared the data;

viii. information about the possibility of not providing consent and about the consequences of refusal;

ix. revocation of consent.

Flexa Cloud will make every effort to fulfill requests as quickly as possible, in accordance with the law. In some cases, certain requests may not be fulfilled immediately due to legal or regulatory obligations.

The User acknowledges that deleting information essential to managing their account may result in the termination of their registration and the consequent cancellation of services provided.

Right to petition the ANPD. If you believe that your rights have not been adequately respected, you have the right to file a complaint with the National Data Protection Authority (ANPD) through the official channels available at [website address]. https://www.gov.br/anpd.

9. LEGISLATION AND JURISDICTION

This Policy is governed, interpreted and enforced in accordance with the laws of the Federative Republic of Brazil, especially Law No. 13.709/2018 (LGPD), regardless of the laws of other states or countries. The court of the User's domicile is chosen to settle any disputes arising from this document.
