A Flexa Cloud Brasil Ltda, a legal entity governed by private law registered with CNPJ under No. 21.464.937/0001-98, headquartered in Vila Velha/ES (“Flexa Cloud”), understands as sensitive and relevant the electronic records and personal data left by you (“ User") in the use of the various sites and services ("Pages") of Flexa Cloud, serving this Privacy Policy ("Policy") to regulate, in a simple, transparent and objective way, which data and information will be obtained, as well as when they can be used.
This Policy applies to Pages related to any of Flexa Cloud's brands, understanding as such all those listed on Flexa Cloud's official website, at the address https://www.flexa.cloud, encompassing all its products.

This Policy may be updated at any time by Flexa Cloud, upon notice on the website and/or by email, if the User has chosen to receive communications from Flexa Cloud.
Flexa Cloud may collect information actively entered by the User at the time of registration, and also information automatically collected when using the pages and the network, such as, for example, identification of the commercial establishment used, IP with date and time of connection, among others.
Thus, two types of personal data are processed: (i) those provided by the User; and (ii) those collected automatically.
i. Information provided by the User: Flexa Cloud collects all information actively entered by the User on the Pages, such as full name, email, gender, date of birth, city and state, when filling out forms on the Pages by the User. Flexa Cloud will use this information to promote the dissemination of advertising material, promotions, discounts, events and loyalty programs, as well as to carry out satisfaction surveys.
ii. Data collected automatically: Flexa Cloud also automatically collects a series of information, such as: characteristics of the access device, the browser, IP (with date and time), IP origin, information on clicks, accessed pages, the following pages accessed after output from the Pages, or any search term typed on or in reference to the sites, among others. For such collection, Flexa Cloud will use some standard technologies, such as cookies, pixel tags, beacons and local shared objects, which are used with the purpose of improving the User's browsing experience on the Pages, according to their habits and their preferences.
It is possible to disable, through the settings of your internet browser, the automatic collection of information through some technologies, such as cookies and caches, as well as on our own website, specifically regarding cookies. However, the User must be aware that, if these technologies are disabled, some features offered by the website, which depend on the processing of said data, may not work correctly.
In addition, Flexa Cloud will be able to promote satisfaction and preference surveys during your use of the Wi-Fi Network, collecting this information to improve our services every day, to better understand your preferences and evaluate the quality and your impressions about our products. , as well as for statistical and advertising purposes.
For the latter hypothesis, Flexa Cloud provides functionalities for the User to authorize (or not) the processing of their data, being certain that such acceptance is not a condition for the User's registration.
The information collected may be shared by Flexa Cloud with: (i) other partner companies, when necessary for the proper provision of services object of its activities; (ii) to protect Flexa Cloud's interests in any type of conflict; (iii) upon court decision or request from the competent authority.
Furthermore, we clarify that your information may also be shared with companies that provide the technological and operational infrastructure necessary for Flexa Cloud activities, such as payment intermediaries and information storage service providers.
The information collected by Flexa Cloud is intended for the establishment of a contractual bond or the management, administration, provision, expansion and improvement of pages to the user, adapting them to their preferences and tastes, as well as the creation of new services and products to be offered to Users.
The information collected may also be used for advertising purposes, such as sending information about brands, products, promotions and discounts from Flexa Cloud, as well as publicizing events and loyalty programs, or carrying out research on purchase satisfaction, with the owner's consent to do so.
Flexa Cloud may centralize the information collected on the Pages, which may be used on Pages and services related to all Flexa Cloud brands, respecting the purposes set forth herein and the User's consent.

Legal Basis: In these cases, data processing is authorized by item I of article 7 of Law No. 13.709/2018, the General Data Protection Law (“General Data Protection Law – LGPD”).

Flexa Cloud is an economic group that works in partnership with several companies. In this way, you may share the information collected through the Pages, in the following cases:
i. With other companies of the Flexa Cloud Group, constituted or operating in any country, which undertake to use the information for the same purposes indicated in this Policy;
ii. With partner companies, in the development of Flexa Cloud's commercial activities;
iii. To protect the interests of Flexa Cloud in any type of conflict, including lawsuits;
iv. In the case of transactions and corporate changes involving Flexa Cloud, hypothesis in which the transfer of information will be necessary for the continuity of services; or,
v. By court order or at the request of authorities administrative bodies that have legal competence for its request.
Flexa Cloud will store the information collected on its Pages on its own servers or those contracted by it.
Flexa Cloud uses reasonable market and legally required means to preserve the privacy of data collected on its Pages. In this way, it adopts the following precautions, in compliance with the guidelines on safety standards established in Decree No. 8.771/2016, such as:
i. Flexa Cloud uses industry standard methods to encrypt and anonymize collected data;
ii. Flexa Cloud has protection against unauthorized access to its systems;
iii. Flexa Cloud only authorizes previously established persons to access the location where the collected information is stored;
iv. Those who come into contact with the information must undertake to maintain absolute secrecy. Breach of secrecy will entail civil liability and the person responsible will be held accountable under Brazilian law; and
v. Inventory maintenance indicating time, duration, identity of the employee or person responsible for access and the object file, based on connection and application access records, as determined in article 13 of Decree No. 8.771/2016.
Flexa Cloud adopts the best efforts, in order to preserve the privacy of the Users' data. However, no site is completely secure and Flexa Cloud cannot fully guarantee that all the information that travels on the Pages is not the target of unauthorized access perpetrated through methods developed to improperly obtain information.
For this reason, we encourage Users to take appropriate steps to protect themselves, such as keeping all usernames and passwords confidential.
Information collected by Flexa Cloud through the Pages will be automatically deleted from its servers when it ceases to be useful for the purposes for which it was collected, or when the user requests the deletion of their personal data.
Without prejudice, the information may be kept for compliance with legal or regulatory obligations, transfer to a third party — provided that the data processing requirements are respected — and exclusive use of the Flexa Cloud, access by a third party is prohibited, provided that it is anonymised.
In compliance with the applicable regulations, with regard to the processing of personal data, Flexa Cloud respects and guarantees the User the possibility of submitting requests based on the following rights:
i. confirmation of the existence of treatment;
ii. access to data;
iii. the correction of incomplete, inaccurate or outdated data;
iv. the anonymization, blocking or deletion of unnecessary, excessive or non-compliant data;
v. the portability of your data to another service or product provider, upon express request by the User;
saw. the deletion of data processed with the User's consent;
vii. obtaining information about the public or private entities with which Flexa Cloud has shared your data;
viii. information about the possibility of not giving your consent, as well as being informed about the consequences, in case of refusal;
ix. the revocation of consent.
Part of these rights can be exercised directly by the User, from the management of information about his account, while others will depend on the submission of a request for subsequent evaluation and adoption of other measures by Flexa Cloud.

The User is aware that the exclusion of essential information for the management of his account with Flexa Cloud may imply the termination of his registration, with consequent cancellation of the services then provided.
Flexa Cloud will make every effort to respond to such requests in the shortest possible time, always observing the applicable legislation. In some cases, deletion requests may no longer be met immediately, due to legal determination.
This Policy will be governed, interpreted and enforced in accordance with the Laws of the Federative Republic of Brazil, in particular Law No. document.
